Tax regimes for freelancers

You need to pay as an individual or as an individual entrepreneur (IP), depending on the activity. If it generates income with a frequency of 2-3 times a year, then it can hardly be classified as entrepreneurial, because it is periodic and unstable in nature. Then there is no need to register as an individual entrepreneur to pay taxes.

If your activity is aimed at systematically making a profit, you need to register as an individual entrepreneur (clause 1 of Article 23 of the Civil Code of the Russian Federation).

When receiving income, an individual must submit a tax return for personal income tax and attach to it documents confirming the receipt of this income (service agreement, receipt, etc.). This can be done in person, through a representative with a notarized power of attorney, electronically, or sent by mail.

An individual entrepreneur can choose from several tax regimes. I would recommend considering two options:

Let’s imagine that a designer earned 2 million rubles in a year, but the basic income in his city is set at 500 thousand rubles, in which case he will have to pay the state 6% of these 500 thousand rubles, and not of the entire amount - that is the tax will be 30 thousand instead of 120 thousand.

However, it must be taken into account that an entrepreneur, regardless of the taxation system, is obliged not only to pay taxes, but also to make insurance premiums and additional insurance contributions for himself and his employees.

A freelance entrepreneur must pay for himself:

  • compulsory pension insurance. It is calculated using the formula: minimum wage (currently equal to 7.5 thousand rubles) * 12 * 26%, which is 23.4 thousand rubles. This formula is valid when the individual entrepreneur’s income for the year does not exceed 300 thousand rubles. The rule for calculating the additional contribution for income over 300,000 rubles per year is as follows: 1% of the amount over the limit is charged, but not more than 163,800 rubles;
  • compulsory health insurance. It is calculated using the minimum wage formula * 12 * 5.1%, i.e. 4,590 rubles.

The freelancer must pay insurance premiums for himself by December 31 of the current year. You can do this in parts.

Advantageous option

It makes more sense to use the patent system if you are confident that real income will significantly exceed the basic income established for your region. Otherwise, it is better to choose a simplified system with a rate of 6%. But the tax rate of 15% under the “income minus expenses” system is most suitable for those whose activities involve a large number of costs.

Under a simplified taxation regime, an entrepreneur can reduce the amount of tax by the amount of insurance premiums he has paid. Therefore, the taxes that a freelancer pays as an individual entrepreneur are most often more profitable than the taxes that an individual is required to pay.

How much do freelancers pay?

Deadlines for paying taxes

The declaration under the simplified tax system, as well as the tax reporting of an individual, is submitted once for the entire calendar year.

An individual payer must submit a tax return no later than April 30 of the year following the expired tax period. If this date falls on a weekend or holiday, the deadline is moved to the first working day after that. The tax itself must be paid by July 15 of the following year.

An individual entrepreneur must also report to the tax office by April 30 (except in cases where the individual entrepreneur ceases its activities or if it has lost the right to apply the simplified tax system). At the same time, taxes must also be paid before this date (Article 346.21 of the Tax Code of the Russian Federation).

Tax breaks for freelancers

Since a freelancer is an individual, he has all the tax benefits provided for individuals: standard deduction, social deduction or property deduction.

He can also take advantage of benefits in the form of exemption from income tax on benefits from the state, pensions, subsidies, employee compensation, alimony, financial assistance from the employer, income from the sale of real estate, provided that he has owned it for more than three years.

If a freelancer fails to pay taxes, he faces penalties and criminal liability.

According to the Tax Code of the Russian Federation, for violation of the deadline for submitting a tax return, a fine is provided in the amount of 5% of the amount of tax (insurance contributions) for each month, but not more than 30% of the specified amount and not less than 1,000 rubles. Also, the tax debtor will have to pay 20% of the unpaid amount.

  • a fine from 100 thousand to 300 thousand rubles or in the amount of wages for a period of up to two years;

  • arrest for up to 6 months;
  • imprisonment for up to 1 year.

The issue of wages is perhaps the most pressing in freelancing. Most often, problems arise due to the legal impropriety of transactions, but no less often they appear at the negotiation stage.

On the one hand, copywriters, SMM managers, targetologists, directologists, designers are absolutely the same professions as a journalist or advertising platform sales manager. These are independent professions that are decently paid. An experienced freelancer always has an income that is not comparable to that of an office worker, and a freelancer sees returning to the office only in his worst nightmare.

On the other hand, clients do not take freelancers seriously and do not understand the value of their work. You're just starting out, which means the prices are minimal.
